Welcome to Darien Clothing Co. (“Darien Clothing Co.”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and online store located (the “Site”) and any purchases you make from us (collectively, the “Services”).

By accessing or using the Site, or by placing an order with us, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services and place orders. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

You may be able to create an account on our Site to save information and view order history.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • You agree to provide accurate, current, and complete information and to keep it updated.

  • You are responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be fraudulent.

3. Products & Orders

3.1 Made-to-Order / Print-on-Demand

Most of our products are made to order through a print-on-demand fulfillment partner. This means:

  • Items are produced only after you place an order.

  • Slight variations in color, placement, or print may occur between items and mockups.

  • Production and shipping times can vary, especially during busy seasons.

3.2 Order Acceptance

All orders placed through the Site are offers to purchase products. We may accept or reject any order for any reason, including:

  • Product availability

  • Errors in product information or pricing

  • Suspected fraud or unauthorized/illegal activity

If we cancel an order after payment, we will issue a refund for the full purchase price of the cancelled items.

3.3 Order Information

You agree to provide accurate and complete information for all orders, including your shipping address and contact details. We are not responsible for delays or losses due to incorrect or incomplete information.

4. Pricing, Payments & Taxes

  • All prices are listed in [currency, e.g., USD] unless otherwise stated.

  • We reserve the right to change prices at any time without prior notice, but changes will not affect orders already placed.

  • Payment is due at the time of order. We accept the payment methods shown at checkout (e.g., credit/debit cards, Shop Pay, PayPal, etc.).

  • You are responsible for any applicable sales, use, VAT, or other taxes, duties, or fees that may apply to your order, as determined by your shipping address and local laws.

If a product is listed at an incorrect price due to typographical error, pricing error from our vendor, or technical issue, we reserve the right to cancel or adjust the order and notify you.

5. Shipping & Delivery

We ship orders using our fulfillment partners and carriers listed at checkout.

  • Processing time: Most items are produced within the timeframe shown at checkout. This is an estimate and not a guarantee.

  • Shipping time: Delivery estimates are provided by the carrier and may vary due to location, carrier delays, holidays, or other circumstances beyond our control.

  • Risk of loss: Risk of loss and title to products transfer to you upon delivery to the shipping carrier.

If tracking indicates that your package has been delivered but you have not received it, please contact the carrier first, then contact us at tyler.bradham.ironhorse@gmail.com if it cannot be located.

6. Returns, Exchanges & Refunds

By placing an order, you acknowledge and agree to our Returns & Refunds Policy, including any limitations on returns or exchanges for made-to-order products.

In general (summary only—see full policy for details):

  • We will replace or refund items that are damaged, misprinted, or defective, when reported within our specified timeframe.

  • Because items are custom printed, we typically cannot accept returns for wrong size or change of mind, except as described in our policy.

7. Intellectual Property

All content on the Site—including without limitation logos, graphics, text, product designs, images, and layout—is owned by or licensed to Darien Clothing Co. and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, reproduce, distribute, publish, display, or create derivative works from our content or designs without our express written permission.

  • Use our name, logo, or branding in any manner that could cause confusion or imply endorsement without consent.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only.

8. User Content (Reviews, Photos, Submissions)

If you submit content to us—such as reviews, photos, social media tags, or other materials (“User Content”)—you represent that:

  • You own or have the necessary rights to such content.

  • Your content does not violate any law or infringe on the rights of others.

By sharing User Content with us (for example, tagging us on social media or emailing photos), you grant Darien Clothing Co. a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, display, and distribute that content in connection with our business, including for marketing on the Site, social media, and advertising, without additional compensation to you.

We may remove or decline to use any User Content at our sole discretion.

9. Prohibited Uses

You agree not to use the Site or Services:

  • For any unlawful purpose or to violate any local, state, national, or international law.

  • To harass, abuse, insult, harm, defame, or discriminate against any person or group.

  • To upload or transmit malicious code, viruses, or any other type of harmful software.

  • To collect or track personal information about others without consent.

  • To interfere with or circumvent the security features of the Site or any related website, other websites, or the Internet.

We reserve the right to terminate your access to the Site for any violation of these Terms.

10. Third-Party Services

Our store is hosted on Shopify, and we use third-party services such as Printful for production and fulfillment, and third-party payment processors for transactions.

Your use of those services may also be subject to their own terms and privacy policies. We are not responsible for the actions, content, or policies of any third-party services, and you agree that your dealings with them are solely between you and the third party.

11. Disclaimer of Warranties

To the fullest extent permitted by law:

  • The Site, Services, and products are provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied.

  • We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free.

  • We make no warranties regarding the quality of any products, services, information, or other material purchased or obtained through the Site, or that any errors will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of Liability

To the fullest extent permitted by law, Darien Clothing Co., its owners, employees, and affiliates will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or goodwill

arising out of or related to your use of the Site, the Services, or products purchased from us, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Services or products will be limited to the amount you paid for the specific product(s) giving rise to the claim.

Some jurisdictions do not allow the limitation of liability for certain damages, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Darien Clothing Co. and our owners, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Services

  • Your breach of these Terms

  • Your violation of any law or the rights of any third party

  • Any User Content you submit or share

14. Governing Law & Dispute Resolution

These Terms and any separate agreements whereby we provide you Services will be governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict of law provisions.

Any disputes arising under or related to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in The United States of America, Georgia, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Changes are effective when posted on the Site.

Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Site.
